Children under 12 years of age will be permitted to ride with an accompanying adult\u00a0 provided the life vest provided fits correctly (Min body weight 12kg).<\/span><\/p><p>All children <strong>MUST<\/strong> be supervised by a guardian 18 years of age or older whilst on the water<\/p><p>All participants hire equipment at their own risk and are required to sign a \u2018Hire Agreement\u2019 prior to departure.<\/p><p>Participants must not to carry more than the maximum limit of people authorised by In Motion Fitness Kayak Tours &amp; Hire and the Australian Marine Safety Authority (AMSA) as listed:<\/p><ul><li>Single Kayak = 1 adult not exceeding a 110kg capacity<\/li><li>Double Kayak = 2 adults + 1 child under 4 years not exceeding a 270kg capacity<\/li><li>Stand Up Paddle Board = 1 adult not exceeding a 120kg capacity.<\/li><\/ul><p>Participants must wear appropriate clothing for paddle\/water sport activity.\u00a0<span style=\"font-style: inherit;\"><b>JEANS ARE NOT ALLOWED.<\/b><\/span><\/p><p>Use of equipment is not permitted between the hours of sunset and sunrise.<\/p><p>Participants are wholly responsible for the hire equipment, its passengers and appliances and third parties whilst the Kayaks\/SUP(s) or equipment are in their control for the period of hire. Participants agree to exercise due care and accept responsibility, during the same period, toward any incident that may occur, and will promptly reimburse In Motion Fitness Kayak Tours &amp; Hire in the event of any loss or damage to the equipment and\/or to any other person or property.<\/p><p>Participants agree to return the hire equipment to In Motion Fitness Kayak Tours &amp; Hire at the POINT OF HIRE on completion of the agreed hire period.<\/p><p>Participants acknowledge the inherit dangers and risks and agree that the hiring of the equipment is entirely at their own risk.<\/p><p>Participants shall indemnify In Motion Fitness Kayak Tours &amp; Hire of any incident, loss or damage to the equipment, any third party person or property during the period of the hiring and acknowledge that they will not be covered by any of In Motion Fitness Kayak Tours &amp; Hire insurance if found negligent or irresponsible whilst the kayak, SUP or any equipment is under their control.<\/p><p>In Motion Fitness Kayak Tours &amp; Hire will not be held responsible for any personal injuries, equipment loss or damage sustained whilst embarking or disembarking In Motion Fitness Kayak Tours &amp; Hire&#8217;s equipment.<\/p><p>Passengers with back, neck, shoulder or heart conditions, or those who are pregnant or who have injuries\/conditions that may cause a risk to their health participate at their own risk.<\/p><p>In Motion Fitness Kayak Tours &amp; Hire operates in an outdoor marine environment.<\/p><p>Conditions vary and passengers will get wet.<\/p><p>No smoking or alcohol is permitted on the equipment at any time.<\/p><p>In Motion Fitness Kayak Tours &amp; Hire reserves the right to refuse service to those who are believed to be affected by alcohol or drugs and no refund will be provided.<\/p><p>In Motion Fitness Kayak Tours &amp; Hire reserves the right to refuse passengers for any reason.<\/p><p>Participants may be filmed\/photographed during the hire period. In Motion Fitness Kayak Tours &amp; Hire reserves the right to reproduce such film\/photos for any purpose whatsoever without notification, compensation or payment.<\/p><p>\u00a0<\/p><h2><strong>Booking Conditions<\/strong><\/h2><p>All bookings (including gift voucher\/certificate bookings) are non-refundable within 24 hours of departure.<\/p><p>Cancellations must be received at least 24 hours prior to departure or full payment will be due and no refund will be given<\/p><p>Full refund is permitted on booking cancellations made outside of 24 hours from departure time.<\/p><p>Rescheduling of a booking is permitted outside of 24 hours from departure time<\/p><p>Any cancellations or non arrivals within 24 hours will incur a 100% cancellation fee.<\/p><p>Bookings made within 24 hours of departure are non-refundable.<\/p><p>In Motion Fitness Kayak Tours &amp; Hire reserves all rights to cancel or reschedule the activity in the event of adverse weather conditions or other unforeseen circumstances.<\/p><p>It is up to In Motion Fitness Kayak Tours &amp; Hire\u2019s discretion as to whether it is safe for bookings to go ahead.<\/p><p>In Motion Fitness Kayak Tours &amp; Hire reserves all rights to cancel or reschedule an activity if numbers do not meet the minimum requirements.<\/p><p>If In Motion Fitness Kayak Tours &amp; Hire must cancel an activity due to inclement weather, or for any other reason, the activity will be rescheduled. If the activity cannot be rescheduled full refund will be processed.<\/p><p>\u00a0<\/p><h2><strong>Kayak Tour Conditions<\/strong><\/h2><p>All prices included are inclusive of GST.<\/p><p>No refund will be given for bookings cancelled within 24 hours of scheduled tour departure.<\/p><p>In Motion Fitness Kayak Tours &amp; Hire \u00a0reserves the right to cancel tours at short notice due to unsuitable weather\/river condition or any other reason. If a cancellation occurs, In Motion Fitness Kayak Tours &amp; Hire will attempt to re-schedule. If the tour cannot be rescheduled a full refund will be provided.<\/p><p>Our tours can be short through to long distance, and involve paddling within exposed marine surroundings ie: possible wind, currents etc. In Motion Fitness Kayak Tours &amp; Hire endeavours to provide a safe experience, as easy going as possible however, all participants must acknowledge this <strong>BEFORE PROCEEDING<\/strong> and be confident of their fitness levels and adventurous nature before deciding to participate.<\/p><p>All Adults MUST have swimming ability despite being provided with a PFD.
